Two seasoned public sector practitioners will provide an overview of and strategic advice regarding two public sector statutes – the Prohibition on Public Employer Deterring or Discouraging Union Membership (“PEDD,” Government Code sections 3550-3553) and the Public Employee Communication Chapter (“PECC,” Government Code sections 3555-3559). The two statutes were passed in 2017 in anticipation of the U.S. Supreme Court’s decision in Janus v. AFSCME Council 31 and were amended over the years to make them even stronger. Unions can use the laws to grow union membership and solidarity in their bargaining units, support new organizing, and fend off interference and misinformation by management.
